      <title>Class Action Lawsuit Filed Against Petco</title>
      <description>&lt;p&gt;A &lt;a href="http://www.kansascity.com/business/story/118853.html"&gt;class action lawsuit &lt;/a&gt;has been filed in New York against the pet retailer Petco and the pet food distributor Pet Food Experts Inc.  The lawsuit stems from allegations that the pet chew Greenies was harmful to dogs and that the manufacturer knew this but did nothing to warn consumers.  The chews were sold at Petco. &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;The plaintiffs in the lawsuit, which was filed in state court, are asking for reimbursement on their purchases of the "original" Greenies dental chews for dogs between June 2001 and May 22, 2007.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;A class action lawsuit has also been filed against the manufacturer S&amp;M NuTec over the product.       <title>Global Plastics Recalls Paper Towel Dispensers Due To Fire Risk</title>
      <description>&lt;p&gt; &lt;/p&gt;
&lt;p&gt;&lt;a href="http://www.globalplastics.com/"&gt;Global Plastics Ltd&lt;/a&gt; recently announced a voluntary recall of &lt;a href="http://www.cpsc.gov/cpscpub/prerel/prhtml09/09763.html"&gt;Bay West &amp;amp; Hillyard Hybrid Wave N Cut Paper Towel Dispensers&lt;/a&gt;, because the electric board can overheat posing a fire hazard.&lt;/p&gt;
&lt;p&gt;To this date, no injuries have been reported but the company has received two reports of the dispensers overheating.&lt;/p&gt;
&lt;p&gt;The recalled products are Bay West &amp;amp; Hillyard Hybrid Wave N Cut Paper Towel Dispensers. The product can function in mechanical or electronic mode.&lt;/p&gt;
&lt;p&gt;Consumers should remove the batteries from the dispenser and use the mechanical function to avoid a fire hazard. Global Plastics should be contacted for instructions on how to receive a replacement.&lt;/p&gt;

      <title>Pedestrian Hit by Louisiana State Representative</title>
      <description>&lt;p&gt;A Louisiana State Representative hit a pedestrian in Terrebonne Parish with her car on Sunday.  The pedestrian's arm was broken in the &lt;a href="http://www.katc.com/Global/story.asp?S=7040747"&gt;car accident&lt;/a&gt;.  State Representative Carla Dartez was driving the car.  The accident took place on Bayou Black Road.&lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;Dartez failed parts of the field sobriety test but passed a breathalyzer test administered soon afterward with a "0.00" score, said Trooper Gilbert Dardar Jr., State Police Troop C spokesman.&lt;/p&gt;&lt;p&gt;"I was not drinking," Dartez said. "It was just an accident."&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;Dartez was issued a ticket for improper lane usage.  This was not her first driving offense.       <title>FDA Found Concerns at Merck Vaccine Plant</title>
      <description>&lt;p&gt;&lt;p _extended="true"&gt;The FDA found &lt;a name=http://www.foxnews.com/story/0,2933,352563,00.html&gt;contaminated children's vaccines&lt;/a&gt; and other problems at a Merck &amp;amp; Co. plant in Philadelphia that was combed.&lt;/p&gt;
&lt;p _extended="true"&gt;According to an unpublished FDA report acquired by the Philadelphia Inquirer, inspectors found 49 areas of concern, including unwanted fibers found on vaccine vial stoppers, failure to follow good management practices, and contamination of bulk lots of vaccine.&amp;nbsp;&lt;/p&gt;
&lt;p _extended="true"&gt;Inspectors visited the plant on 30 separate days from November to January.&amp;nbsp; In December the company recalled 1.2 million doses of an influenza vaccine made at the Philadelphia plant due to sterility problems and the plant also quarantined near a yeas worth of other suspect doses.&lt;/p&gt;
&lt;p _extended="true"&gt;A Merck executive, John McCubbins stated that none of the finished vaccines were contaminated and the company is fixing the problems.&amp;nbsp; The FDA has not ordered Merck to stop production and is reviewing how the company responds to the report.&lt;/p&gt;&lt;!-- QUIGO --&gt;&lt;!-- QUIGO --&gt;

      <title>Zyprexa Class Action Now Includes 8 States</title>
      <description>&lt;p&gt;There are now eight states that have filed a &lt;a href="http://www.legalnewsline.com/news/197757-oregon-ag-may-lead-multi-state-class-action-v.-drugmaker-blogger"&gt;class action lawsuit&lt;/a&gt; against Eli Lilly, the maker of the drug &lt;a href="http://www.injuryboard.com/view.cfm/Topic=791"&gt;Zyprexa&lt;/a&gt;.  The lawsuits have been filed because Eli Lilly allegedly advertised the drug for uses that were not approved by the FDA.  They also claim that the drug manufacturer did not properly warn of potential side effects.  &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;A representative from Myers' office confirmed Tuesday that Oregon "is part of the leadership states (Executive Committee) for a multi-state case concerning Eli Lilly and Zyprexa", Dawdy reported. Myers would use in-house staff rather than private lawyers as Montana recently did, the official added.&lt;/p&gt;&lt;p&gt;Just over two years ago, Indianapolis-based Eli Lilly announced it had paid around $690 million to settle claims, including class-action lawsuits, over claims it minimized Zyprexa's side-effects.       <title>Teen Dead After Being Run Over by Float</title>
      <description>&lt;p&gt;A driver towing a float in a Carnival parade accidentally ran over and killed his 16-year-old brother.&lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;Clay Michael Sayer was standing between Kain N. Sayer's pickup truck and the float behind it, talking to riders on the float during a brief stop around 5 p.m. Saturday, Trooper Scott Moreau said. The teen was pinned by the float when the truck started moving again, Moreau said.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;&lt;br /&gt;Kain Sayer, 21, was charged with vehicular homicide, drunken driving and careless driving.       <title>Navy to Pay $2 Million in Wrongful Death</title>
      <description>&lt;p&gt;The Navy rented a bus that hit a car and killed a man in 2004.  The bus did not have any power steering fluid.  The wife of the man killed sued the Navy and the bus rental company for &lt;a href="http://www.dailypress.com/news/local/southofjames/dp-95598bf0aug01,0,3398833.story"&gt;wrongful death&lt;/a&gt;.  The jury found the Navy and Eddie's Bus Service responsible for his death and awarded the widow $3 Million in damages.  &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;Peter Williams was stopped on River Road on Sept. 9, 2004 - waiting for a traffic light - when the bus turned left and struck his Pontiac Grand Am.       <title>Lawsuit Filed Against Baton Rouge for Fatal Accident</title>
      <description>&lt;p&gt;Several lawsuits have been filed against the city-parish of &lt;a href="http://www.2theadvocate.com/news/6527692.html"&gt;Baton Rouge for road conditions that caused a fatal car accident&lt;/a&gt;.  On March 5, 2006 two men were killed and a woman suffered serious injuries.  The accident happened on Sullivan Road near Sparkle Road.  &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;The Cantys' lawsuit maintains the passenger side tires of Canty's car went off the road because of "defective conditions and (road) design." When Lamar Canty tried to regain control, the lawsuit says, he overcorrected and drove into the path of Harris' 2000 Nissan Altima.&lt;/p&gt;&lt;p&gt;The Cantys' lawsuit names the city-parish, the Louisiana Department of Transportation and Development and city of Central as defendants. Harris' lawsuit names the city-parish and the DOTD as defendants.&lt;/p&gt;&lt;p&gt;There is a question about whether the Cantys' lawsuit was filed on time. In Louisiana, lawsuits generally must be filed within a year of an incident.&lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;Initial paper work was filed on time, but a hard copy and fees were not presented until after the deadline.       <title>Nursing Home Death Being Investigated</title>
      <description>&lt;p&gt;The Louisiana state attorney general is looking into the death of a woman who passed away during an evacuation from Huntington Place Senior Community prior to Hurricane Katrina's landfall.  Thelma Wall, a resident of the nursing home, died on an unairconditioned bus used to evacuate occupants from the Chalmette facility, which has been sued for wrongful death four times since the year 2000.       <title>Baton Rouge Car Accident Injures Secretary of State</title>
      <description>&lt;p&gt;A &lt;a href="http://blog.nola.com/times-picayune/2007/08/dardenne_undergoes_surgery.html"&gt;car accident&lt;/a&gt; on Interstate 12 in Baton Rouge left the Secretary of State injured and in need of surgery.  He had injuries to his chest, back, and pelvis.  The  two car accident happened last week.  The driver of the other car was not injured.  &lt;/p&gt;&lt;p&gt;&lt;blockquote&gt;Dardenne was traveling in the center lane of Interstate-12 near its split with I-10 in Baton Rouge last Monday when his Infiniti veered to the right and brushed another car. &lt;/p&gt;&lt;p&gt;Police said Dardenne over-corrected for drifting right and yanked the steering week, causing his car to veer to the left and leave the highway and run on a median where he hit a drainage ditch. &lt;/blockquote&gt;&lt;/p&gt;&lt;p&gt;He had surgery on Monday and is expected to be fine.
